GENERAL CONDITIONS OF SALE

Article 1 – Scope of Application

These General Conditions of Sale (“GCS”) govern all sales of products and services concluded via the websites, sales funnels, or platforms operated by DAMIAN VAN DAM (hereinafter referred to as “the Company”).

Any natural or legal person placing an order with the Company, whether for digital products, physical products, or services, is considered a “Customer”.

Placing an order implies full and unconditional acceptance of these General Conditions of Sale.

Article 2 – Age Restrictions

The Company applies strict age restrictions:

Minimum age of 16 years for digital and physical products
Minimum age of 18 years for services (including but not limited to coaching, consulting, workshops, seminars, and group programs)

The Company reserves the right to request proof of age.
Any order placed in violation of these age limits will be cancelled, refunded, and—where applicable—the return of the product will be required.

Article 3 – Products and Services

The Company offers:

Digital products (online courses, downloadable content, PDFs, audio/video materials)
Services (music composition, coaching, consulting, 1:1 sessions, group programs)
Physical products produced on demand

Article 4 – Ordering Process

An order is considered final once payment has been validated via the secure payment platform.

The Company reserves the right to refuse or cancel any order in the event of:

Payment issues
Fraud suspicion
Violation of these GCS

Article 5 – Prices

Prices are displayed in euros (€) and include all applicable taxes (VAT according to French regulations), unless otherwise stated.

Prices do not include delivery costs for physical products, which are indicated prior to order validation.

The Company reserves the right to modify its prices at any time.
The price applicable is the one displayed at the time of the order.

Article 6 – Payment Terms

Payment is due immediately upon ordering, including for pre-orders.

Accepted payment methods:

Credit and debit cards (Visa, Mastercard)

Payments are processed via Stripe and PayPal, a secure payment service provider.
The Company does not store any banking data.

Article 7 – Delivery

7.1 Digital Products

Digital products are delivered electronically, either via download or access credentials, immediately or within the timeframe stated on the sales page.

7.2 Physical Products

Physical products are shipped to the address provided by the Customer.
Delivery times are indicative only.

Risk transfers to the Customer upon dispatch.

7.3 Services

Services are delivered according to the schedule and modalities defined on the sales page or agreed upon individually.

Article 8 – Right of Withdrawal (B2C Only)

8.1 General Rule

In accordance with EU consumer law, Customers have a 14-day right of withdrawal from the date of purchase, except in the cases listed below.

8.2 Exclusion – Digital Content

The right of withdrawal does not apply to digital content once delivery or access has begun, provided that the Customer has expressly agreed to immediate performance and acknowledged the loss of the right of withdrawal.

By placing an order for digital products, the Customer expressly:

Requests immediate access
Waives the right of withdrawal

8.3 Exclusion – Services

The right of withdrawal does not apply once a service has been fully performed or has begun with the Customer’s express consent.

Article 9 – Intellectual Property

All content, products, and materials provided by the Company are protected by intellectual property laws.

Any reproduction, distribution, resale, or exploitation without prior written authorization is strictly prohibited.

Article 10 – Liability

The Company is bound by a best-efforts obligation.

The Company shall not be held liable for:

Indirect damages
Loss of profit
Business interruption

The Customer remains solely responsible for the use and implementation of the information, products, or services provided.

Article 11 – Personal Data Protection

Personal data is processed in accordance with the General Data Protection Regulation (GDPR).

Details regarding data collection, processing, and rights of access, rectification, and deletion are described in the Company’s Privacy Policy.

Article 12 – Force Majeure

The Company shall not be held liable for failure to perform due to events beyond its reasonable control (force majeure).

Article 13 – Applicable Law and Jurisdiction

These General Conditions of Sale are governed by French law.

In the event of a dispute:

Consumers may refer the matter to the competent courts
Professionals agree to the exclusive jurisdiction of the courts within the jurisdiction of the Company’s registered office
